The owners of the two cars live in the brown house. An unlicensed 16-year-old was out joy riding in his father’s Nissan — without permission — at around 4 am this morning with two other kids. He struck the silver car and continued into the red car, which was pushed forward six feet from where it was parked. The silver car was pushed onto the curb, and the impact forces were such that they knocked off all of the Nissan’s hubcaps. To his credit, the kid stuck around until the cops came. Minimum property damage limit in California is $5,000. That should cover the damage...

I cannot guess what the sequence of events might have been, but I’m guessing automobile theft and leaving the scene of an accident would have been involved, and sides of hoonery and General Mayhem. From the assortment of parts on the ground, it seems a third car might have been involved.

That’s deeply on fortunate for the owner. I can relate. I once had both of my street parked cars hit by another parked vehicle that rolled down the street after the parking brake failed. A flatbed wrecker rolled down the street and into my former Mazda MX-6. The stinger lift on the back rode up over the hood of the car, grabbed it by the a-pillar and shoved it back into my former 96 suburban that was parked behind it. It pushed the suburban back about six feet down the street, coming to a stop only a few inches from the front bumper of the neighbors car behind it.

I started the call to my insurance agent with the word “you’re not going to believe what just happened.. .” My beloved (and significantly modified) MX-6 was totaled in the end, and the insurance claims took months to resolve and very nearly resulted in lawyers and lawsuits before I got enough of a payout on the MX-6 to call off the lawyers.

All of the cars in my fleet, five or six in total, and all of them dependable drivers, added together, cost less than $20k, over many years, repairs and parts and maintenance notwithstanding. There is an upside to owning beaters.

My daughter tapped the back bumper of a five-day-old Tesla the other day. Waiting to hear the estimate on that one... And by tapped , to hear her tell the story, we mean tapped.

The real problem on mine was that the MX-6 was worth substantially more than what a normal book value would be on one via all the restoration and modification, of which I had extensively documented with my insurance company before hand (without which I would’ve been boned).

Because the tow truck (belonging to a small town Ford dealer North of Las Cruces) wasn’t currently registered or insured (nor was the guy who unsuccessfully parked even licensed to drive a vehicle of any kind ), I initially had to file a claim against the business’ s general liability policy. Despite no question as to fault, their company basically told me where to stick it and offered a $ 2500 settlement on the whole thing (I think they really wanted me to sue the driver in his personal capacity thereby making it not their problem) . Once the lawyers got involved, they basically said sue us...

As a last step before doing that (of which I would’ve won and most likely gotten a good payout on, two years later...), I filled with my own insurance company. Because of the extensive prior documentation, they paid out close to 7k on the MX-6, which was double it’s book value and just enough on the dollar invested for me to bitterly swallow. They also paid out a couple grand on the Suburban for essentially a broken license plate bracket and mildly bent bumper.

Because the fault was completely uncontested, they filled a sub ro ga tion claim with dealership’s general liability policy and eventually came to a settlement with them. I wasn’t entitled to know what they finally settled on, but by law I was entitled to first $1000 they got to account for the deductibles. About six months later I got the two $500 checks to reimburse me for the deductible and the claims were dropped from my record (and clue report) as chargea ble accidents.

In the end, I bought the MX-6 back from them for around $200 and then dragged it up on to my trailer and sold it to a salvage yard $350 ( being a college student in an apartment, I didn’t have the space to part it out at the time). I took the money on the suburban claim and replaced the front license plate bracket and decided to happily live with a very slightly bent bumper. It worked out in the end (and probably paid for almost a year of school), but I really missed my MX-6. That car had been my high school graduation gift to myself, later sold to my dad who drove it as his daily for a number of years (in part because of my habit of setting the cruise at 120 in the  car), and then later I bought it back from him. It was our autocross car for many years, and eventually is developed a rod knock via some oil starvation at a track day. I then really started working on it and swapped in a JDM spec motor for +40hp over the USDM engine those cars came with on this continent among other things along with generally making it an almost perfect old MX-6.

The MX-6 was parked about 10-12 feet up the road, and suburban was originally around 6 feet further up the street.  I should probably do a proper write up of this as an Oppo post sometime.
